These Terms of Service (“Terms”) govern your access to and use of Curate King (the “Service”) provided by Famous Factory Inc. (“Curate King”, “we”, “us”, “our”). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Eligibility; Accounts
- You must be at least 18 years old to use the Service.
- You agree to provide accurate account information and keep it up to date. You are responsible for activities under your credentials.
- If you connect third-party destinations (e.g., WordPress Sites), you are responsible for the accounts and permissions on those services.
2. Acceptable Use
- No unlawful, infringing, defamatory, or deceptive content.
- No spam, bulk unsolicited outreach, or malicious automation.
- No reverse engineering, scraping, or bypassing access controls.
- Do not attempt to publish to destinations you do not own/control or have permission to manage.
- Respect the terms of any third-party services you connect or use with Curate King. You are solely responsible for your compliance with those terms.
3. Your Content; Publishing
- You retain ownership of your content. By using the Service, you grant CurateKing a limited license to process, store, and transmit your content solely to provide the Service (including AI-assisted drafting and publishing).
- You represent and warrant you have all rights to the content you provide or generate with the Service, including rights to publish to connected destinations and to use any media you upload or instruct us to use.
- You are responsible for reviewing and approving drafts prior to publishing. Curate King does not guarantee factual accuracy or legal compliance of generated content.
4. Intellectual Property; Feedback
- We own the Service and all related IP (software, UI, documentation, logos), excluding your content and third-party materials.
- If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction.
5. Plans, Billing & Taxes
- Curate King is currently offered through private access and approved workspaces.
- If paid access applies, pricing, included features, usage limits, and renewal terms will be provided in the applicable order form, checkout flow, or written agreement.
- Prices and features may change; we will give reasonable notice for material changes to active paid plans where required.
- No refunds. Except where required by law, all fees are non-refundable, including for partial billing periods or unused features.
- You are responsible for applicable taxes; we may charge taxes as required by law based on your billing information.
- Late or failed payments may result in suspension or termination of access.
- Trial or preview access, if offered, may be limited by workspace configuration and may not include publishing.
6. Cancellation & Termination
- You can cancel at any time in your account or by contacting support@curateking.com. Your plan remains active through the current billing period.
- We may suspend or terminate access immediately for material breach (e.g., abuse, non-payment, legal risk). We will make reasonable efforts to notify you unless prohibited by law or security concerns.
- Upon termination, your account may be disabled and scheduled content may be canceled. We may retain minimal records as required by law or for legitimate business purposes (e.g., security, audit).
7. Privacy
Our Privacy Policy explains how we collect and process personal data. By using the Service, you agree to our data practices as described there.
8. Third-Party Services & Links
The Service may integrate with third-party services for publishing, analytics, email, authentication, anti-abuse, billing, or automation. We are not responsible for third-party services and do not control their terms, privacy, or availability.
Your use of third-party services is solely between you and those providers. You authorize us to share or receive data with such services as needed to provide the integrations you enable.
9. AI & Generated Outputs
- Generated content may contain inaccuracies. You are responsible for review, fact-checking, and compliance with applicable laws.
- You must not rely on generated content for legal, medical, or financial advice.
- You must not use generated content to violate intellectual property or publicity rights.
10. Disclaimers; Limitation of Liability
- The Service is provided “as is” without warranties of any kind.
- Curate King is not liable for indirect, incidental, or consequential damages, or for loss of profits, revenues, or data.
- Our total liability is limited to the greater of $100 or the fees you paid in the 6 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-product notice. Continued use of the Service after changes become effective constitutes acceptance.
12. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in Wilmington, Delaware, unless we mutually agree to arbitration.
