Terms of Service

1. Eligibility; Accounts

• You must be at least 18 years old to use the Service.
• You agree to provide accurate account information and keep it up to date. You are responsible for activities under your credentials.
• If you connect third-party destinations (e.g., WordPress Sites), you are responsible for the accounts and permissions on those services.

2. Acceptable Use

• No unlawful, infringing, defamatory, or deceptive content.
• No spam, bulk unsolicited outreach, or malicious automation.
• No reverse engineering, scraping, or bypassing access controls.
• Do not attempt to publish to destinations you do not own/control or have permission to manage.
• Respect third-party terms (e.g., WordPress, Slack, ConvertKit, Resend, Plausible, Cloudflare Turnstile). You are solely responsible for your compliance with those terms.

3. Your Content; Publishing

• You retain ownership of your content. By using the Service, you grant CurateKing a limited license to process, store, and transmit your content solely to provide the Service (including AI-assisted drafting and publishing).
• You represent and warrant you have all rights to the content you provide or generate with the Service, including rights to publish to connected destinations and to use any media you upload or instruct us to use.
• You are responsible for reviewing and approving drafts prior to publishing. CurateKing does not guarantee factual accuracy or legal compliance of generated content.

4. Intellectual Property; Feedback

• We own the Service and all related IP (software, UI, documentation, logos), excluding your content and third-party materials.
• If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction.

5. Plans, Billing & Taxes

• Some features are free; paid plans (“Subscriptions”) are billed in advance on a recurring basis until canceled.
• The Pro plan includes unlimited drafts and publishes for up to 5 Sites and is priced at $29/mo or $288/yr (billed annually at the equivalent of $24/mo).
• The Business plan offers custom pricing, unlimited Sites, service-level agreements (SLA), and dedicated onboarding. Contact sales for a proposal.
• Prices and features may change; we will give reasonable notice for material changes to paid plans.
• No refunds. Except where required by law, all fees are non-refundable, including for partial billing periods or unused features.
• You are responsible for applicable taxes; we may charge taxes as required by law based on your billing information.
• Late or failed payments may result in suspension or termination of access.
• Trials provide draft-only access for 3 days with 1 Site and up to 5 drafts; publishing unlocks upon upgrade to a paid plan.

6. Cancellation & Termination

• You can cancel at any time in your account or by contacting support@curateking.com. Your plan remains active through the current billing period.
• We may suspend or terminate access immediately for material breach (e.g., abuse, non-payment, legal risk). We will make reasonable efforts to notify you unless prohibited by law or security concerns.
• Upon termination, your account may be disabled and scheduled content may be canceled. We may retain minimal records as required by law or for legitimate business purposes (e.g., security, audit).

7. Privacy

Our Privacy Policy explains how we collect and process personal data. By using the Service, you agree to our data practices as described there.

8. Third-Party Services & Links

The Service integrates with third parties (e.g., WordPress publishing, Resend email, ConvertKit newsletter, Plausible analytics, Cloudflare Turnstile anti-abuse, optional Slack webhooks). We are not responsible for third-party services and do not control their terms, privacy, or availability.

Your use of third-party services is solely between you and those providers. You authorize us to share or receive data with such services as needed to provide the integrations you enable.

9. AI & Generated Outputs

• Generated content may contain inaccuracies. You are responsible for review, fact-checking, and compliance with applicable laws.
• You must not rely on generated content for legal, medical, or financial advice.
• You must not use generated content to violate intellectual property or publicity rights.

10. Disclaimers; Limitation of Liability

• The Service is provided “as is” without warranties of any kind.
• CurateKing is not liable for indirect, incidental, or consequential damages, or for loss of profits, revenues, or data.
• Our total liability is limited to the greater of $100 or the fees you paid in the 6 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-product notice. Continued use of the Service after changes become effective constitutes acceptance.

12. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in Wilmington, Delaware, unless we mutually agree to arbitration.
